How Long Do You Have To File a Premises Liability Lawsuit in Mobile?

Alabama Premises Liability Laws: What Is a Premises Liability Lawsuit?
In Alabama, a property owner’s duty depends on the visitor’s legal status. Of these groups, invitees have the strongest protections, licensees have more limited protections, and trespassers have the least.
- Invitees are on the property for the owner’s benefit, such as customers and tenants. Owners must exercise reasonable care to keep the premises safe and must either fix or warn about hazards they know or should reasonably be aware of.
- Licensees include social guests and others there for their purposes. Owners must warn of known dangers that are not obvious, but they don’t usually have to inspect for unknown hazards.
- Trespassers are people on the property without permission. They are generally owed a limited duty. However, owners must avoid “wanton or intentional injury” and use reasonable care once they are aware that a trespasser is in danger (§ 6-5-345). Force that is justified as “self‑defense” under Alabama’s Stand Your Ground law may be a defense to liability (§ 13A-3-23).
Alabama courts apply the open and obvious rule, which means owners are usually not liable for hazards that are plainly visible to a reasonable person. Alabama also follows pure contributory negligence, which can bar recovery if the injured person is found even slightly at fault.
