What To Do After a Slip & Fall

It’s not unusual to be confused, overwhelmed, or unsure what to do after a slip and fall accident. Take a breath. Your health and your claim will both benefit from taking the following steps. However, should you be unable for any reason, don’t fret. Our slip and fall injury lawyers in Mobile can help.

Right After the Fall

  • Get medical care. Tell your medical provider exactly how you fell and every part of your body that is in pain.
  • Report the incident to the store, property manager, or security, and request a copy of the written report.
  • Document the hazard with photos and video. Get several angles of the danger, if possible, along with the lighting, any warning signs, and the surrounding area.
  • Preserve your footwear and clothing. Do not clean or repair them.
  • Collect names, numbers, and statements from witnesses, coworkers, employees, etc.

Within the Next 24–48 Hours

  • Ask the business or property owner to preserve surveillance video and maintenance logs. Security camera systems often overwrite in a matter of days.
  • Follow all medical recommendations and keep your appointments.
  • Do NOT give a recorded statement to any insurer before you speak with an attorney.
  • Start a pain and recovery journal. Note things like sleep issues, missed work, pain levels, mental state, and activities you cannot do.

To protect your rights and your potential claim for compensation, Morris, Andrews, Talmadge & Driggers, LLC recommends that you contact an experienced Mobile premises liability lawyer as soon as possible. Our team is ready to get to work now. We’ll determine liability, handle insurers, and fight for the justice you deserve. Complete our online form or call 844.654.6228 for a free and confidential consultation.

How Long Do You Have To File a Slip & Fall Lawsuit in Alabama?

A statute of limitations is the deadline to take legal action. It tells you how long you have to file your slip and fall lawsuit. For most Alabama personal injury cases, you have 2 years from the date you were hurt (Alabama Code § 6-2-38(l)).

You do not have to finish medical treatment or settle within 2 years, but you must file a lawsuit by the deadline to protect your right to compensation. If you miss it, the court can dismiss your case, and the property owner’s insurer generally has no duty to pay a time-barred third-party claim, which also eliminates your leverage to negotiate. Therefore, it’s in your best interest to reach out to our team of seasoned Mobile slip and fall injury attorneys as soon as possible.

Government claims have extra rules and shorter notice periods. If your claim involves a city, you must submit a written notice of claim within 6 months (§ 11-47-23). For counties, claims generally must be presented within 12 months (§ 11-12-8). Claims against the State of Alabama may need to be filed with the State Board of Adjustment within as little as 1 year (§ 41-9-65).

Treat government deadlines as urgent. If there is any chance that a sidewalk, building, or facility is city, county, or state-controlled, contact us right away so we can send the required notices within the correct time limits.

Alabama Laws You Need To Know

The law isn’t always the easiest to understand, especially if it’s not in your wheelhouse. However, Alabama law and how it applies to your case will shape our approach. We want you to be able to participate in this process and the decision-making that goes into it. Our job is to explain the law, lay out your options, and fight for your best interests.

Visitor Status

Your visitor status affects what the owner owes you in terms of a duty of care.

  • Invitees: An invitee can be a shopper, patient, or other guest who is on the premises for the owner’s benefit. In this case, the owner must exercise reasonable care to keep the property safe and warn of any hidden dangers. Think of grocery stores, big box retailers, hospitals, and office lobbies.
  • Licensees: A licensee is a social guest who is invited but not there for business. An owner must avoid willful or wanton harm and warn about dangers they already know about. This can include a friend’s home or a backyard gathering.
  • Trespassers: A trespasser is someone who is on the property without permission. Owners owe a limited duty not to willfully or wantonly injure them.

Because the property owners duty of care changes with your status, it can affect your ability to recover compensation and the amount available. Invitees generally have the strongest protections. Licensees may have narrower rights. Trespassers can only recover in limited circumstances.

Notice

To hold a property owner responsible, we must prove they knew about the hazard or should have known about it through reasonable inspection. “Should have known” is called constructive notice. We use maintenance logs, cleaning schedules, store policies, time-stamped photos, video, witness statements, and more to show how long the danger existed and what a careful owner should have done.

Open & Obvious Arguments

Owners often claim that the hazard was “open and obvious,” meaning you should have seen it (Daniels v. Wiley, 314 So. 3d 1213 (Ala. 2020)). Alabama law allows this defense in many premises cases, which is why lighting, sight lines, distracting displays, the color or placement of a liquid or a mat, etc., can be critical factors in your claim. We address this defense head-on with measurements, photos, expert analysis, and more.

Contributory Negligence

Alabama follows a strict contributory negligence rule. If a property owner convinces a court or jury that you were even as little as 1% at fault, it can bar recovery completely. We work to prevent that by showing the hazard was not obvious, that you acted reasonably in the moment, and that the owner’s failures came first.

Potential Damages in a Slip & Fall Case

In a slip and fall case, compensation generally falls into two categories: economic and non-economic damages. In rare situations, punitive damages may also be available.

Economic Damages

These are specific, documentable financial losses caused by the accident.

  • Medical Expenses (ER visits, hospitalization, surgery, doctor visits, imaging)
  • Prescriptions
  • Physical Therapy
  • Future Medical Care
  • Lost Wages
  • Loss of Earning Capacity
  • Rehabilitation & Assistive Care
  • Home or Vehicle Modifications
  • Out-of-Pocket Costs & Replacement Services (childcare, housekeeping, or other costs you had to cover because of your injury)

Non-Economic Damages

These address the human impact of your injuries.

  • Pain & Suffering
  • Emotional Distress
  • Loss of Enjoyment of Life
  • Scarring & Disfigurement
  • Permanent Disability
  • Loss of Consortium (where a spouse’s relationship is affected)

Punitive Damages

These damages are available only in very rare cases, and not many slip and fall claims. They are awarded when conduct is especially wanton or malicious (§ 6-11-20). Punitive damages are meant more to punish and deter the wrongdoer, rather than to compensate for losses.

Each case will be unique in itself. The best way to determine which damages may apply to your claim is to speak with our experienced team. We can review your situation and decide on next steps.

Who’s Liable for Your Injuries?

Responsibility for your slip and fall injuries could rest with one party or several. Potentially liable parties may include:

  • Property Owners
  • Tenants
  • Property Managers
  • Maintenance & Janitorial Contractors
  • Security Companies
  • Third-Party Vendors
  • Landlords or Homeowners (in rental settings)
  • City or County Entities (e.g., public sidewalks, parks, or buildings)

Determining liability is the foundation of your claim. Once we determine who is legally responsible, we can then make a claim with the correct insurer, calculate damages, and assess your priorities, needs, and goals. Our Mobile slip and fall injury lawyers walk you through every step with the aim of maximizing your recovery.

Common Causes of Slip & Falls

Falls prove to be one of the most frequent sources of injury in the United States, especially for older adults (CDC). Alabama health agencies offer prevention resources that can help during recovery (ADPH).

Common causes of slip and fall accidents include:

  • Wet or Uneven Surfaces: Spilled liquids, freshly mopped floors without warning signs, and uneven flooring or transitions.
  • Poor Weather Conditions: Moisture or tracked-in rain can leave walking surfaces slick, especially in areas with inadequate drainage or traction.
  • Inadequate Lighting: Makes it hard to see steps, elevation changes, or obstacles.
  • Clutter & Obstacles: Cords, boxes, or debris left in walking paths create trip hazards.
  • Missing Handrails or Barriers: Lack of proper handholds or edge protection increases the risk of falls.
  • Loose Floor Mats & Rugs: Mats or rugs that are curled, buckled, or unsecured can slide or catch a foot.
  • Unmarked Hazards: Step-downs, raised thresholds, or wet or newly waxed surfaces without clear warnings.

Property owners and managers have a duty to keep their premises reasonably safe and to warn about hidden dangers. If a failure to do so led to your injury, you may be entitled to compensation.

If your fall occurred while you were on the job, you may have a premises claim in addition to your rights under workers’ compensation. Learn more when you contact our work injury attorneys in Mobile.
